JUDICIAL PISSING CONTEST

 So - the Supreme Court yeasterday afternoon released their ruling regarding Texas's "Right" to arrest, detain, and export those it feels have entered the USA illegally within its borders ...

At least that's the way they made it sound on Good Morning America (ABC) this morning ... and it almost sounded like in a 6-3 ruling (so ONE of the judges appointed by a Democrat President voted WITH the Rebulican appointed judges, but they didn't really say) 

It sounds as if 6 of the judges felt that Texas was within its LEGAL AUTHORITY to do so ... it can ARREST, DETAIN, AND DEPORT those WITHIN ITS BORDERS which can be PROVED to have entered the country UNLAWFULLY!

So, of course - just before MIDNIGHT - last night - the 5th District Appeals Court, once again BARRED Texas from doing so.

This has come down to being a Pissing contest between the 5h Dustrict Appeals court and the Supreme Court of the United States ...

I've got news for the 5th District ...

You're gonna LOSE ... 

The way this works is very simple:
~case goes to regular court
~case is appealed in local court
~case gets appealed to State Appeals court
~case get appealed to District court
~case gets appealed in Supreme Court
~case is settled ... for now, until a DIFFERENT case brings the subject back up.

My understanding by the reporting is that there was NO second, different case ...
So the midnight 5th District of Appeals ruling would have to be on the exact same case -- and that's not allowed!

UNLESS - it is on a different aspect within the same case, but generally the Appeals Cours will only look at ONE appeal per case ... otherwise the court system would be backed up beyond  ...

oh wait ...

yeah, that might explain the back up we have now ...
