Unhappy home buyer, feeling misled on price, sues agent: "'They simply didn't do what is expected of a knowledgeable, sophisticated buyer, and are now looking for someone other than themselves to take responsibility,' Roger Holtsclaw, an agent who was hired by Little as an expert witness, said in a court deposition."
This is true--property taxes are a matter of public record. You can go online and look up the taxes on the property, any special levies, and what the house is worth--this is a lot better than it used to be when we first looked at a house.
When you buy a house you should get a flyer that tells you everything about the house...taxes, avg. utilities, 'fair market price' according to the county, etc. its right there with the dimensions of the rooms, the number of baths.
All you have to do is open your eyes.
The worse problem is when you end up in a situation like we had...the woman was put into assisted living and the family gave the son-in-law power of atty to sell the house...so when it came to the truth-in-housing form he put down 'unknown' for just about everything. We almost backed out of the deal...sometimes I almost wished we had...
like when we discovered after we moved in that they had a leak in the kitchen faucet and instead of replacing the washer they compounded it down! That was a fun one.
Went to wash our dishes and found the faucet head wouldn't move to fill the sink...no matter how much I pushed or pulled...hubby walked in and tried...he got out the pipe wrench...still wouldn't move. Finally we figured it out and that weekend he went and got everything he needed to replace it--and put in the shut-off valves that we hadn't check for before.
You know its those little things that you take for granted that you forget to look for when you are buying your first home.
Things like---flush the toilet while running the shower...how's the pressure? How's the water temp? Have someone listen to the toilet flush in the basement....does it stop dripping soon after flushing or does it drip for quite a while afterwards indicating a bad seal? Get a good look at the underflooring under the bathroom with a flashlight...any water stains? It could be just overflowing toilets, but it could also mean future bills from wood rot.
There is so much that a person is supposed to think of....but that's not what your broker is doing!
Their job is to find you a house within your price range...its still up to YOU to check things out!
Now if they PURPOSEFULLY hid defects in the home--that is something different....totally different. If they didn't tell you that every spring you have an indoor pool where there is supposed to be, that's an issue. If they told you that your property line was farther over than it really was...that's also an issue. Or if they forgot to tell you about the death that occured there three years ago--that is a major issue.
But not letting you know you were spending too much??
That's not their job! You should have realized something was going on, also---who ever buys the first house they look at? I would think if there were other houses in the area you would want to look at them as well.
Maybe its just me.
