This is not supposed to happen ...
There ae not supposed to be gray areas in the law ...
but the border is one of them .... at least the southern border - the northern border as well, but they aren't in the news at the moment ...
First, the border with Mexico can very from yer to year, season to season ... because it is based on the Rio Grande ... people who have ranches along the border can tell you about how much land they have lost over the years ....
in fact, I saw a story where one gal had lostt a whole section of her family property, which had been in her family since the Mexican War, when the river flooded and changed its course -- the new course cut the land off from the rest of the property.
She stried to get help to claim it back and was told - sorry, it doesn't work that way.
Imagine that in the 1800s ... or the early 1900s and you can bet there'd have been a different reaction.
So the actual border is the first gray area ...
the second gray area is WHO is supposed to be in charge of keeping people from crossing the borders?
Simple answer is the federal border patrol ... but they haven't been doing that lately, or well, according to the Texas government ....
Texas felt they needed to take charge of the border in one part of the state and put up some razor white (and it is exactly what it sounds like, coiled whire with razor blades woven into it) .... there has been an incident of a person with 2 children (I want to say it was a woman) who got tangled into the wire after trying to cross illegally and drowned before they were found.
Someone had called the Border Patrol to come rescue them, but when they arrived it was too late .... either way, the local patrol would not allow the feds onto/into the area where the bodies were pulled from the river.
The feds decided they were going to cut the wire and remove it ... Texas said "no" and refused to let them near it.
So the feds took Texas to court over control of the international border.
They decided to ask the Supreme Court to decide if the wire could stay or if it should go ...
The Supreme Court decided that the wire could be removed before the lower court decision came in ...
in a 5-4 vote ....
This does not equate to a decision on the actual case ... only on the wire ...
yeah ...
Right ....
but its a good question ... when is it okay for the states to step up when they percieve the feds have dropped the ball?
Its a case to keep an eye on.
